Privacy statement: Works, operations and events

Port of Antwerp-Bruges NV (public limited company) under Public Law (hereinafter "Port of Antwerp-Bruges", "we" or "us") attaches great importance to the protection of personal data. Personal Data are all the information about an identified or identifiable natural person (hereinafter the "data subject", "you", or "your").

 

We will always protect your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR) including any applicable current or future national or international legislation implementing or replacing the GDPR (hereinafter collectively "Applicable Privacy Legislation").

 

This notification on the processing of your personal data (hereinafter "Privacy Statement") was drawn up to clearly inform you about the processing of your personal data and your rights as a data subject.

1. Application of this statement

This privacy notice applies to the processing of personal data of the following categories of data subjects:

  • individuals carrying out and commissioning works on the Port of Antwerp-Bruges site that requires (pre-)notification
  • individuals and principals of works that require a nautical admission from the Port of Antwerp-Bruges.
  • individuals carrying out and commissioning works, operations and events in the port area that affect shipping.

3. Overview of the processing

1. Individuals and principals of works that require a nautical admission from the Port of Antwerp-Bruges

(Personal) data

  • company name
  • name
  • e-mail address
  • telephone or mobile number.

Purpose

  • To ask the person concerned for information about the planned works and to communicate the decision on the nautical admission.
  • To inform port users by nautical message of works, operations or events at the port that affect shipping traffic and to enable them to contact the principal and contractor directly.
  • To contact the person concerned in the event of any operational problems or calamities.

Legal basis

The processing is necessary for the performance of a task in the public interest, i.e.:

  • monitoring the safety of works, operations and events carried out at Port of Antwerp-Bruges sites, both on behalf of those implementing the works, the operations, or the events and on behalf of the other port users.
  • access control for Port of Antwerp-Bruges buildings.

 

The need to comply with a legal obligation incumbent upon Port of Antwerp-Bruges, i.e.:

  • access control for ISPS facilities belonging to Port of Antwerp-Bruges.
  • providing contacts for works, operations or events affecting the shipping industry to the port users and sending the same information by NtS message to other RIS authorities (Directive 2005/44/EC of the European Parliament and of the Council on harmonised river information services (RIS) on inland waterways in the Community and Commission Regulation (EC) 414/2007 of 13 March 2007 concerning the technical guidelines for the planning, implementation and operational use of river information services (RIS)).

2. Individuals carrying out and commissioning works, operations and events in the port area that affect shipping

  • company name
  • name
  • e-mail address
  • telephone or mobile number

Purpose

  • To inform port users by nautical message of works, operations or events at the port that affect shipping traffic and to enable them to contact the principal and contractor directly.
  • To contact the person concerned in the event of any operational problems or calamities.

The processing is necessary for the performance of a task in the public interest, i.e.:

  • monitoring the safety of works, operations and events carried out at Port of Antwerp-Bruges sites, both on behalf of those implementing the works, the operations, or the events and on behalf of the other port users.
  • access control for Port of Antwerp-Bruges buildings

 

The need to comply with a legal obligation incumbent upon Port of Antwerp-Bruges, i.e.:

Purpose

  • Requesting access and coordinating the planned and current works.
  • Contacting the contractor in case of emergencies.

Legal basis

The processing is necessary for the performance of a task in the public interest, i.e.:

  • monitoring the safety of works, operations and events carried out at Port of Antwerp-Bruges sites, both on behalf of those implementing the works, the operations, or the events and on behalf of the other port users.
  • access control for Port of Antwerp-Bruges buildings.

 

The need to comply with a legal obligation incumbent upon Port of Antwerp-Bruges, i.e.:

  • access control for ISPS facilities belonging to Port of Antwerp-Bruges.
  • providing contacts for works, operations or events affecting the shipping industry to the port users and sending the same information by NtS message to other RIS authorities (Directive 2005/44/EC of the European Parliament and of the Council on harmonised river information services (RIS) on inland waterways in the Community and Commission Regulation (EC) 414/2007 of 13 March 2007 concerning the technical guidelines for the planning, implementation and operational use of river information services (RIS)).

The processing of the personal data is mandatory, since in the event of failure to provide the data, the controller can no longer comply with its statutory obligation, i.e.:

  • access control for ISPS facilities
  • informing port users of works, operations or events affecting the shipping industry

4. Source of personal data

4.1 In addition to the personal data that Port of Antwerp-Bruges obtains directly from you, it also processes personal data from another source, namely:

  • for individuals carrying out and commissioning works for which a nautical permit is required: from the person who has applied to Port of Antwerp-Bruges for the nautical permit: company name, name, e-mail address and telephone number.
  • for individuals carrying out and commissioning work on a Port of Antwerp-Bruges site where a (pre-)notification is required: from the person who created the pre-notification: company name, name, e-mail address and telephone number.
  • for individuals carrying out works, operations and events in the port area with impact on shipping: from the principal: company name, name, e-mail address and telephone number (for composing nautical message).

5. Categories of recipients

In the context of this processing, your personal data will be transferred to third parties within the EU, namely:

  • the company name, name, e-mail address and telephone number of the contractor and principal to the RIS authorities of third countries for the purpose of informing inland skippers calling at the ports of Antwerp and Zeebrugge when works are being carried out. This is done by means of NtS messages (notices to skippers).

6. International transfers

Your personal data will not be transferred outside the European Economic Area.

7. Retention period

Port of Antwerp-Bruges will keep your personal data for a 3-month period.

  • You can request access to and receive a copy of any personal data we have processed concerning you.

  • You can request that your personal data be deleted.
  • You can object to the processing of your personal data, request that we restrict the processing of your personal data or request the portability of your personal data.
  • You can also object, free of charge, to the processing of your personal data for direct marketing purposes by contacting Port of Antwerp-Bruges at the address below or by using the unsubscribe link in any direct marketing communication.
  • If we collect and process your personal data with your consent, you can withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of any processing based on your consent before it is withdrawn.
