Privacy Statement: Pre and post-measurement of railway crossing safety

Port of Antwerp-Bruges NV (hereinafter "Port of Antwerp-Bruges", "we" or "us") attaches great importance to the protection of personal data. Personal Data is all the information about an identified or identifiable natural person (hereinafter the "data subject", "you", or "your"). We will always protect your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or "GDPR") including any applicable current or future national or international legislation implementing or replacing the GDPR (hereinafter collectively "Applicable Privacy Legislation").

 

This notice on the processing of your personal data (hereinafter referred to as "Privacy Statement") has been drawn up to clearly inform you about the processing of your personal data and your rights as a data subject. As such, please read this document thoroughly and contact us if you have any questions via the contact details in Article 9 below.

1. Application of this statement

This Privacy Statement applies to the processing of personal data for the following categories of data subjects: the people concerned are individuals who pass by the cameras installed at railway crossing 16 on Steenlandlaan in Beveren. A pre and post-measurement for a pilot project with a VRI for the purpose of securing railway crossings will be conducted at this location. Counter loops on the one hand and survey cameras on the other will be used for this pre and post-measurement. Based on these measurements, the speed driven and the number of red light negations will be evaluated, so that it can be determined whether the installation of a VRI leads to an increase in safety at the railway crossing.

Personal data

The purpose of the pre and post-measurement is not to capture personal data, although it may occasionally occur that individuals or, in very rare cases, number plates come into view recognisably.

Legal basis

General interest: within the Port of Antwerp-Bruges' task as a road authority, it strives to ensure safe use of the road network. Increasing safety at railway crossings, although not a direct responsibility of Port of Antwerp-Bruges, is part of this.

4. Source of personal data

4.1. Port of Antwerp-Bruges processes the personal data it captures directly through the cameras set up, for the purposes stated in this Privacy Statement. 

5. Categories of recipients

In accordance with Applicable Privacy Legislation, your personal data will be shared with Nationwide Data Collection BV, which as will carry out this processing as a contractor on behalf of Port of Antwerp-Bruges. A processing agreement has been signed with this processor.

6. International transfers

Your personal data will not be transferred outside the European Economic Area (EEA).

7. Retention period

Port of Antwerp-Bruges shall retain your personal data for as long as is necessary for the purposes set out in Article 3. The current schedule anticipates that the project can be completed by the end of 2023. After that time, the personal data shall be deleted/anonymised.

8. Your rights as a data subject

In accordance with the Applicable Privacy Legislation, you may exercise the following rights (if and to the extent applicable):

  • You can request access to and receive a copy of any personal data we have processed concerning you;
  • You can also request that your personal data that is incorrect or incomplete be corrected or completed;
  • You can request that your personal data be deleted;
  • You can object to the processing of your personal data, request that we restrict the processing of your personal data or request the portability of your personal data.
