Port of Antwerp-Bruges NV under public law (Port of Antwerp-Bruges), Port of Antwerp-Bruges International NV (POABI), Antwerp/Flanders Port Training Center NPO (APEC), Railport Antwerpen NV (Railport) and Nationale Maatschappij der Pijpleidingen NV (NMP) (hereinafter referred to as "the joint controllers", "we" or "us") attach great importance to the protection of personal data. Personal Data are all the information about an identified or identifiable natural person (hereinafter the "data subject" or "you").
 

We will always protect your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR) including any applicable current or future national or international legislation implementing or replacing the GDPR (hereinafter collectively "Applicable Privacy Legislation").
 
This notification on the processing of your personal data (hereinafter "Privacy Statement") was drawn up to clearly inform you about the processing of your personal data and your rights as a data subject. As such, please read this document thoroughly and contact us if you have any questions via the contact details in section 9 below.

4. Source of personal data

In addition to the personal data they obtain directly from you, the joint controllers also process personal data from another source, namely:
 

  • For individuals carrying out and commissioning works for which a nautical permit is required from Port of Antwerp-Bruges: from the person who has applied to Port of Antwerp-Bruges for the nautical permit.
  • For individuals carrying out and commissioning work on a Port of Antwerp-Bruges site where a (pre-)notification is required: from the person who created the pre-notification.
  • For individuals carrying out works, operations and events in the port area with impact on shipping: from the principal.

5. Categories of recipients

In accordance with Applicable Privacy Legislation, your personal data may be shared with:
 

  1. RIS authorities of third countries to inform bargemasters calling at the Port of Antwerp-Bruges during the period of works. This is done by means of NtS message (Notice to Skippers).
  2. Other functions and affiliated companies within Port of Antwerp-Bruges: authorised service providers who help us manage our operations such as:
    • Buyers, potential buyers or acquirers, of all or part of Port of Antwerp-Bruges (and their professional advisors);
    • and national or international governmental, regulatory and enforcement authorities.

6. International transfers


In the event that we transfer your personal data to a third country or international organisation (i.e. outside the EEA), we will ensure that your personal data is either transferred only to third countries that are deemed by the European Commission to provide an "adequate" level of protection (a list of adequate third countries is available on the European Commission's website) or if your personal data is not transferred to a country that provides an adequate level of protection, we will provide appropriate safeguards (e.g., enter into EU standard contractual clauses or binding corporate rules with the recipient and implement the necessary additional measures) to ensure that your personal data remains protected in accordance with Applicable Privacy Legislation.

7. Retention period

We will retain your personal data for no longer than is necessary for the purposes for which it was collected as set out in the diagram above (Section 3). More specifically, the personal data mentioned above is kept for a period of five years from the day the data is stored in our systems.

8. Your rights as a data subject

In accordance with the Applicable Privacy Legislation, you may exercise the following rights (if and to the extent applicable):
 

  • You can request access to and receive a copy of any personal data we have processed concerning you;
  • You can also request that your personal data that is incorrect or incomplete be corrected or completed;
  • You can request that your personal data be deleted;
  • You can object to the processing of your personal data, request that we restrict the processing of your personal data or request the portability of your personal data.
  • You can also object, free of charge, to the processing of your personal data for direct marketing purposes by contacting Port of Antwerp-Bruges at the address below or by using the unsubscribe link in any direct marketing communication.
  • If we collect and process your personal data with your consent, you can withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of any processing based on your consent before it is withdrawn.
