Port of Antwerp-Bruges NV under public law (Port of Antwerp-Bruges), attaches great importance to processing of personal data, i.e. information that enables us to identify you as a private individual. Personal data arise whenever it is possible to make a direct or indirect link between one or more items of data and a private individual ("natural person").

Your personal data will always be protected by us in compliance with the "Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC: the General Data Protection Regulation (GDPR)" and the national legislation implementing this Regulation.

This privacy declaration has been issued to provide clear information concerning the processing of your personal data.

We ask you as the reader to pass on this declaration to all persons whose personal data we process and who are in direct contact with you.

  1. Responsibility for the processing
     
    1. The data controller for this processing is Port of Antwerp-Bruges with registered office at the Zaha Hadidplein 1 in B-2030 Antwerp, enterprise number 0248.399.380.
    2. You can reach the Data Protection Officers of Port of Antwerp-Bruges via dpo@portofantwerpbruges.com.
    3. In its capacity of data controller, Port of Antwerp-Bruges shall take all appropriate technical and organisational measures to protect personal data against accidental or unauthorised destruction, accidental loss, and any unauthorised processing of personal data.
    4. Port of Antwerp-Bruges will continue to ensure that personal data are processed in a lawful, proper and transparent manner; that personal data are collected for specific, expressly defined and justified purposes and that they are not subsequently processed in any manner incompatible with those purposes; that personal data are sufficient, relevant and limited to what is necessary for the purposes mentioned; that the personal data are correct and, if necessary, updated; that personal data are not kept longer than necessary for the purposes mentioned.     5. Port of Antwerp-Bruges guarantees that no transfer to third countries for data processing or storage shall take place without taking the necessary measures to comply with the protection requirements of the European privacy regulations.
       
  2. Who is concerned

    The reporter or the person who makes a report via the hotline of Port of Antwerp-Bruges.
     
  3. The personal data that we process
     
    1. In this case, Port of Antwerp-Bruges collects the following personal data:

      Reports can be made anonymously if so desired. In that case, the person reporting must take into account that Port of Antwerp-Bruges cannot provide any reaction or solution.
       
      • Email address
      • First name
      • Surname
         
    2. Under no circumstances shall Port of Antwerp-Bruges collect special categories of personal data, such as data concerning race, political opinions, health, religious and other beliefs and sexual orientation.
       
    3. In addition, Port of Antwerp-Bruges collects personal data to guarantee the proper operation of the hotline. Port of Antwerp-Bruges uses several resources to optimise the user experience and to analyse any technical errors:
       
      • Log information: this regards information like the IP address and various telecommunications data.
      • Information with regard to the device used, e.g., hardware and software information and network information.
      • Local storage information.
      • GPS location (if active on the side of the reporting person): this may be used to better specify the location of the report. The reporting person can opt to either or not transmit the GPS location.
         
  4. Sources of personal data

    Port of Antwerp-Bruges only processes the personal data that it obtains directly from you.
     
  5. Purposes for which the data are processed
     
    1. Personal data will be processed for the following purposes: Providing the reporting person with targeted and accurate information about the report, or requesting additional information, as necessary, for accurate and efficient handling of the report.
       
    2. Your personal data will not be passed on to third parties in the context of this processing.
       
  6. Legal basis for processing

    Our legal basis for processing your personal data is as follows:

    Processing is necessary for the performance of a task in the public interest, i.e., handling and following up on the report as accurately as possible to optimise the operations of Port of Antwerp-Bruges.

  7. Retention period

    Port of Antwerp-Bruges retains your personal data for as long as is necessary for the purposes set out in Article 4. After that, the personal data will be removed. For more information, please contact dpo@portofantwerpbruges.com.

  8. Your rights as a data subject

    You may exercise your rights at any time by sending an email (with proof of identity in the form of a copy of the front of your identity card) to dpo@portofantwerpbruges.com. Port of Antwerp-Bruges will draw up a reply within one month. You may personally exercise some of the rights through the settings.
     
    1. You have the right to withdraw your consent at any time, without prejudice to the lawfulness of the processing based on consent prior to withdrawal.
       
    2. If personal data are processed for the benefit of direct marketing, you are entitled at any time to object to such processing, including to any profiling that is related to direct marketing. Port of Antwerp-Bruges applies direct marketing when it sends out newsletters or invitations to events if you have given your consent to do so. You may also unsubscribe from such direct marketing via the link provided at the bottom of the emails in question.
       
    3. You have the right to object at any time to the processing of personal data concerning you on grounds relating to your specific situation if Port of Antwerp-Bruges’s decision is based on legitimate interests or the public interest. In this respect, you must argue the specific reasons. Port of Antwerp-Bruges will then cease the processing unless it invokes compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms as a data subject or that are related to the institution, exercise, or substantiation of a legal claim.
       
    4. You have the right to obtain a definite answer from Port of Antwerp-Bruges as to whether personal data relating to you are processed and, if so, to gain access to that personal data. When responding to this request, Port of Antwerp-Bruges will also include the details of the processing. Port of Antwerp-Bruges will send you a copy of the personal data that are processed.
       
    5. You have the right to obtain from Port of Antwerp-Bruges without delay the rectification of any inaccurate personal data relating to you. You can also have incomplete personal data completed. In some cases, you can correct or supplement your personal data yourself, for example by accessing an application.
       
    6. You have the right to obtain the personal data relating to you, which you have provided to Port of Antwerp-Bruges, in a structured, common, and machine-readable form, and you have the right to transfer this data to another data controller. This is possible if the processing is based on consent or on an agreement to which you, as a data subject, are a party, or if the processing is carried out by automated means.

    7. Finally, you always have the right to lodge a complaint with the supervisory authority, i.e., the Data Protection Authority.
